An ordinance amending Paragraph 1 of Shelby County Ordinance 1989-1 so the ordinance reads as follows:

AN ORDINANCE ADOPTING BY REFERENCE THE PRIVATE WATER WELL CONSTRUCTION PERMIT RULES OF THE IOWA ADMINISTRATIVE CODE, SECTION 567 (CHAPTER 38), FOR SHELBY COUNTY, IOWA.

WHEREAS, the State of Iowa has enacted legislation requiring a permit from the Department of Natural Resources prior to the construction of any new water wells in the State, and

WHEREAS, the Iowa Department of Natural Resources has adopted rules to implement the said statutory provisions (1987 Iowa Code Supplement Section 455B.18F),

BE IT ENACTED by the Board of Supervisors of Shelby County, Iowa, that the said Chapter 38 of Iowa Administrative Code in its entirety shall henceforth be the private water well rules of Shelby County.

EFFECTIVE DATE: This ordinance shall be in effect after its final passage, approval and publication as provided by law.
