AN ORDINANCE REGARDING THE DISPOSAL OF YARD WASTE IN THE UNINCORPORATED AREAS OF SHELBY COUNTY, IOWA.

BE IT ENACTED by the Board of Supervisors of Shelby County, Iowa:

SECTION 1. Purpose. The purpose of this ordinance is to establish the requirement for separation of yard waste from all other waste products, in order to comply with Chapters 455B and 455D Code of Iowa (1989), as amended, and Iowa Administrative Code Chapter 567-105.

SECTION 2. Definition. Yard waste means debris such as grass clippings, leaves, garden waste, brush and trees. Tree stumps are not included.

SECTION 3. Separation and Disposal. Yard waste shall be kept separate from all other waste products. Yard waste shall be disposed of by the owner in an appropriate manner. Yard waste may be disposed of at the Shelby County Landfill in conformance with rules established by the Shelby County Solid Waste Agency. Yard waste shall not be placed in road right-of-way unless it is to be collected for disposal within forty-eight hours.

SECTION 4. Emergency Conditions. In case of a natural disaster or other emergency conditions, as established by the Board of Supervisors, special disposal procedures may be implemented by resolution of the Board.

SECTION 5. Repealer. This ordinance supersedes all previously written or unwritten policies and procedures on yard waste disposal. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

SECTION 6. SEVERABILITY Clause. If any section, provision, or part of this ordinance shall be judged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.

SECTION 7. When Effective. This ordinance shall be in effect after its final passage, approval, and publication as provided by law.

Adopted and passed by the Board of Supervisors of the County of Shelby this 5th day of March, 1991.
